By accessing or using Bloom via FirstSay.app, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access or use our service. These terms apply to all visitors, users, and others who access the app.

2. Description of Service

Bloom is an AI-powered neurodevelopmental learning assistant designed to help parents and caregivers track progress, understand behaviors, and generate evidence-based educational strategies for children with autism, ADHD, speech delay, and other developmental conditions.

3. Medical Disclaimer

The information, assessments, screening tools, and observational insights provided by Bloom are strictly for educational and informational support purposes. Bloom does NOT diagnose, treat, or cure any medical condition or developmental disorder.

Any reliance on the information provided by the app is solely at your own risk. Always seek the advice of your physician, pediatrician, licensed therapist, or other qualified healthcare provider with any questions you may have regarding a medical condition or developmental concern. Never disregard professional medical advice or delay in seeking it because of something you have read or analyzed on FirstSay.app.

4. AI Features Disclaimer

Bloom utilizes advanced artificial intelligence, including camera-based observation and real-time web search, to synthesize and recommend strategies. While we strive to base our AI models on current, globally recognized research (2024-2026):

• AI-generated content can occasionally produce inaccurate, biased, or incomplete information ("hallucinations").
• Not all suggested techniques (e.g., ABA, FloorTime, PROMPT) are suitable for every child. You must exercise personal judgment when applying any technique.
• The "Auto-Diagnosis" feature is an educational mapping tool to assist parents in exploring possibilities; it is definitively not a clinical diagnosis.

5. User Responsibilities

You are responsible for the data you input into Bloom and for keeping your device secure. Because Bloom offers optional local storage and passphrase-based end-to-end encryption, you acknowledge that if you lose your passphrase, we cannot recover your encrypted data. You agree to use the app only for its intended purpose of supporting neurodevelopmental care.

6. Intellectual Property

The Service and its original content (excluding user-generated behavioral logs), features, and functionality are and will remain the exclusive property of FirstSay.app and its licensors. Bloom is protected by copyright, trademark, and other applicable laws.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall FirstSay.app, its developers, directors, employees, or affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this service.

8. Indemnification

You agree to defend, indemnify, and hold harmless FirstSay.app and its team from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Service, or from a violation of these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which FirstSay.app operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
